CA 24 July 1996. M acted for a hausband and wife in the purchase of a house and also for B, to whom the purchasers had applied for a loan. B advanced the money on the condition that the balance of the purchase price was provided without resort to further borrowing. M knew purchasers arranging to secure a debt by a second charge on the property but failed to state it in his report to B. Purchasers defaulted and B sold house at a loss. B sought to recover loss from M, alleging breach of contract. M appealed, appeal allowed - B still had to establish what, if any loss was attributable to M`s negligence.
