Barclays Bank plc v Zaroovabli and others - 1997 - All England Law Reports [1997] 2 All ER 19-28(10) .

ChD 6 November 1996. Z registered owner of a property charged by way of mortgage to the bank as security for a loan. The charge stated that no power of granting tenancies of the property without consent of the bank. In 1988 Z granted third defendants a tenancy of the property- not informing them of the bank`s security over the property. Bank commenced proceedings to enforce its security. Third defendant appealed, contending tenancy binding on the bank. Appeal allowed, order for possession discharged.
