A solicitor acted on purchase of property. There was an existing second charge on matrimonial home to secure husbands office premises. The solicitor asked bank whether they required new charge. Bank asked solicitor to act on their behalf. Depts were not repaid, a possession order was taken out on husband and wife. Wife appealed and contended solicitor. The appeal was dismissed.
