"UCB Bank plc v Sharif (deceased)" CA 16 April 1997. The mortgagee`s action for possession. Defendantfather based case on undue influence on the part of borrower son. The mortgagee claimed the mortgagor was independently advised and the bank was fixed with notice of the pertinent facts. Judge ruled defence had no grounds for case as he had been advised by own solicitors throughout.
