CA 12 November 1996. S commenced works demolishing and reconstructing his house which interefered with the party wall and damaged the structure of L`s house. Following an injunction, S served notice under the London Building (Amendment) Act 1939. S repaired damage to L`s house and finished his own. L had accepted offer on his house but it was not sold because of the works. County Court judge awarded L damages for mortgage interest payable from date when house would have been sold. S appealed. Appeal dismissed.
