ChD 22 August 1996. Joint tenancy of agricultural holding. Defendant (D) ceased working on or residing at the holding and family agreed not to deal with the arrangements of D`s beneficial interest in the tenancy. A notice to quit was served by the landlord, requiring possession on Lady Day 1998. Plaintiff (P) issued proceedings ordering D to join in serving of a counternotice, undertaking that if it was found that D shouldn`t have joined the service of the counternotice that P would surrender the tenancy. Application allowed.
