ChD 15 July 1997. By a party wall award under the London Building Acts (Amendment) Act 1939, O was permitted to carry out work on land that was shared by O and C. Award imposed an obligation on O to make good any damage to C`s building. C`s premises were damaged and C registered a caution against O`s title at HM Land Registry. O applied to have caution removed on the grounds that C did not have a cautionable interest. "Held" application allowed.
