CA 16 May 1997. A landlord who serves notices of determination under the Landlord and Tenant Act 1954 s.4 on the occupiers of two flats into which a dwelling had been subdivided shortly before the end of the contractual term and who had been holding over thereafter, is entitled to have the issue of whether there are two tenancies to determine decided on the facts by the court.
