"National Trust... v Ashbrook and others" ChD 20 June 1997. Notwithstanding the broad duty of the trust under the National Trust Act 1907 s29(a) to keep the Trust`s common land as open space, the language of s23 of the act was clear enough to empower the National Trust to erect fences.
