Linkproud Ltd v Ballard - 1997 - Estates Gazette [1997] 26 EG 156-158(3) .

LT 2 December 1996. The landlords L contracted to purchase the freehold of a building divided into flats and paid the vendor the purchase price plus a sum representing arrears of rent and service charges. The vendor had not first offered the freehold to the tenants so they served a purchase notice on the landlords and were entitled to buy the freehold. The LVT held that the sum payable by the tenants did not include the amount for arrears. It was held however that this was included on the grounds that they were not only buying the freehold but also any rights pertaining to it.
