CA 21 November 1996. B employed A on a building subcontract. Following a disagreement about delays, B terminated the agreement, refusing to make any payment on A`s claim for works completed and loss of profit. A later went bankrupt. The trustees (T) issued proceedings against B for the outstanding monies under the subcontract. T appealed against an earlier ruling allowing B`s application for an order under the Arbitration Act 1950 s4, staying all further proceedings. Appeal dismissed.
