"Lowe v South Somerset DC", QBD 7 July 1997. S issued a noise abatement notice following complaints from neighbours about noise from L`s farm. Appealing to the High Court, L claimed both the magistrates and the council had lost sight of the distinction between a nuisance prejudicial to health and one which interfered with the enjoyment of occupation of land (common law nuisance). Appeal dismissed.
