"Halifax Building Society v Richard Grosse & Co", QBD 4 July 1997. Rent review provisions in the underlease of a flat linked to those in headlease. Solicitor instructed by prospective purchaser and H in relation to the purchase by assignment of a long underlease. R was unable to obtain a copy of the headlease and was unaware of extent of rent review provisions. Rent increased under rent review clauses and H took possession and surrendered flat to freeholder. R admitted negligence but claimed H had suffered no loss. Judgment for plaintiff.
