QBD 8 November 1996. Concerns failure by solicitor and surveyor to include `upwards-only` rent review provision in a lease for commercial premises. The plaintiff, the solicitors, paid damages to the landlord and in the present proceedings claimed that the surveyors involved, the defendants, are liable to contribute towards the damages paid. The claim was upheld and the defendants found liable for 20 per cent of the sum paid to the landlord.
