Discusses R v Doncaster Metropolitan Borough Council, ex parte Braim , QBD 1 October 1986, in which it was held that Doncaster Common , the site of the St. Leger horse race, is open space over which the public have recreation rights and the council is obliged to comply with the requirements of the Local Government Act 1972 s123(2A) before it grants an exclusive lease to the golf club.
