In Burke v SoS for the Environment and another , QBD 10 May 1991, it was held that the CPO was not ultra vires for having been made more than 28 days after the control order , there was no precise scheme under Housing Act 1985 for making a CPO following a control order, the applicant had not been prejudiced by the misdating of the CPO and it made no difference that the public inquiry had been conducted on the basis of an earlier date.
