ChD 15 May 1997. R held a 14-year lease of shop premises. P served a notice under Law of Property Act 1925 s146, alleging breaches of the repairing covenant. R failed to pay the rent and a bankruptcy order was served. P peacefully entered the premises for non-payment of rent. Following payment of petitioning creditor, bankruptcy order was annulled. R contended P required leave of the court under the Insolvency Act 1986 s285(3). "Held" leave of court was not required to forfeit the lease.
