ChD 10 December 1996. By two leases, S granted terms of premises by P. On expiration of contract, S remained in possession under tenancies continued pursuant to the Landlord and Tenant Act 1954 until a new lease was granted by the third defendant, X. Under service charge provisions of original leases, S was obliged to pay a depreciation allowance in respect of the cost of maintaining and replacing fixtures and fittings. P had not spent any of this money and X received the depreciation allowance fund on the reversion of the lease. S claimed repayment of the fund. Claim dismissed.
