Landlord and tenant-1978 tenancy agreement provided for four weeks written notice - 1985 tenancy vested in original tenant`s son, D-S moved into property with D-1991 D left owing arrears - Landlord obtained suspended possession order - D signed `statement of intent to pay arrears of rent` - 1994 landlord left written notice to quit at premises, knowing D no longer resided there - proceedings for possession - parties agreed that new tenancy created in 1991 - whether notice to quit effective - whether new tenancy incorporated standard terms of 1978 tenancy- Law of Property Act 1925 s196 - Local Government Act 1972 s223. (Headnote) Held, appeal by second defendant allowed.
