CA 11 March 1997. Landlord was convicted for breach of duty under the Health and Safety at Work etc. Act 1974 following the carbon monoxide poisoning of a woman using a defective gas fire. The defendant was later charged with manslaughter. The Judge rejected an application to stay the indictment on the ground of autrefois convict and the defendant pleaded guilty. On appeal on the grounds that the judge erred in law, the appeal was allowed and the conviction quashed.
