QBD 3 April 1996. Tenants negligently caused a fire destroying one and damaging another unit owned by the plaintiff landlord. The tenants contended that the landlord was contractually obliged to insure the units for the benefits of the tenants. The lease of one unit contained a landlord`s covenant to insure. The landlord claimed damages for negligence against the tenants. Held: The landlord was entitled to damages less 15% for contributory negligence.
