CA 19 June 1997. Roots from a tree growing in the verge of a highway caused subsidence damage to plaintiff`s house. Court upheld plaintiff`s claim for damages against defendant highway authority on basis that they had duty to maintain trees under Highways Act 1980 s96(1). Defendant`s appeal dismissed.
