CA 27 March 1996. The respective plaintiffs (P) acquired unexpired terms of leases of flats in the same building. Each paid substantial premiums. The P were claiming damages against the defendant solicitors for failure to advise that the premiums were unlawful having regard to the provisions of Part IX of the Rent Act 1977. The P claimed damages on the diminution in value basis. They appealed the decision of the judge below who held that diminution in value rule ought not to be applied and that damages ought to be assessed at the date of the trial. Held: the appeals were dismissed.
