LT 22 April 1987 (REF/197/1985) A reference to determine the compensation payable on compulsory purchase of premises in Derby which was originally a dwelling house but was last used as a printing workshop . Planning permission had been granted for Class 111 use under Town and Country Planning Use Classes Order 1972 and an application for retail use under Class 1 was unlikely to have been refused. It was common ground that at the valuation date the premises could have been valued as adapted to retail shop use with the costs of conversion and repair deducted from capital value, or alternatively on an existing use basis with a deduction for cost of repairs. Claimants` valuer arrived at a value of 31,560 as retail shop and 28,428 for light industrial use. The council`s valuer contemplated a more elaborate scheme of conversion costing about 30,000 which he believed would make it uneconomical, so he relied on a valuation of 17,100 for light industrial use.
