"Cavendish Funding Ltd v Henry Spencer & Sons Ltd" CA 24 October 1997. Valuation of property for mortgage purposes. Two valuations were obtained and the lender chose the higher valuation as the basis for a loan. Borrower defaulted and C claimed damages for negligent valuation. Judge found higher valuation negligent. CA "held" C contributorily negligent. C`s damages reduced by 25%.
