There was a contract (JCT with Contractors Design 1981) between Kelsey as employers and Ruddy as contractors, for the construction of certain residential units. Disputes arose with Ruddy in particular claiming that kelsey had wrongfully refused to extend the completion date, and had wrongfully deducted damages for delay for which Ruddy were not responsible. The dispute arose prior to practical completion and was referred to arbitration.
