QBD 20 June 1997. A valuer from WM valued property for mortgage purposes. C granted borrowers a loan without checking their ability to service loan. Relying on WM`s valuation C lent to the borrower and granted a mortgage. Borrower fell into arrears, the property was sold. C contended that the property was worth more at valuation. WMalleged C was contributorily negligent by not making inquiries. Held, judgment for C.
