In "Stovin v Wise (Norfolk CC, third party)", CA 17 February 1994, it was held that although the duty of care imposed on a highway authority by Highways Act 1980 s4(1) to maintain the highway did not require it to carry out work on land not forming part of the highway, there was a common law duty of care owned to all road users by a highway authority to act to alleviate known danger caused by persisting impaired visibility on land adjoining the highway.
