CA 23 July 1997. In 1976 F moved into a flat with T who was the statutory tenant. When in 1994 T died F applied to take over the tenancy, but the landlords refused. F`s application for determination of succession was dismissed, the court holding that F and T`s homosexual relationship was outside the definitions set out in The Rent Act 1977 of a person entitled to succeed the death of a statutory tenant. Appeal dismissed.
