"Bell and others v General Accident Fire & Life Assurance Corporation Ltd" CA 11 December 1997. The defendant company owned the freehold of an office building and in 1978 General Accident (Fire), another company in the group, let part of the building to the plaintiffs. Both parties to the lease were under the impression that General Accident (Fire) owned the freehold and that the provisions of the Landlord and Tenant Act 1954 applied. In 1992 General Accident (Fire) served a notice terminating the tenancy and the tenant served a counternotice. The defendants served an answer under Landlord and Tenant Act 1954 s24a applying to the court to determine a reasonable rent. Subsequently the freehold was sold. The plaintiffs quit the tenancy. On appeal by the plaintiff, it was accepted that a tenancy by estoppel came into being between Fire and Eagle Star. Appeal dismissed.
