QBD 1997. A fracture occurred in one of the defendant`s underground mains causing substantial flooding in the basement and sub-basement owned by the first plaintiff and leased by the second plaintiff. Extensive waterproofing of the basement and sub-basement was subsequently carried out by the second plaintiff but there was evidence of other damp which had been noticeable for eighteen months before the leak. There was no dispute about the defendant`s liability pursuant to the Water Act 1981 s6(1) but as to what extent the works carried out were caused by the defendant`s breach of duty.
