"Spelthorne BC v SoS for the Environment and another", QBD 17 February 1994, concerned application for planning permission for a petrol filling station and car wash which was refused on safety grounds and highway objections but was allowed at appeal on the grounds that development of the site had been included in the structure plan. The planning authority appealed but this was dismissed.
