This article examines break clauses in commercial leases exercisable by the tenant only. Examines the landlord`s position, considering such aspects as successors in title and time of the essence and the tenant`s position, referring to performance of repairing covenants , dilapidations and new tenants. Goes on to discuss the effect of break clauses on new developments, looking at the options available to an investor if a break clause is exercised during a developer`s twenty-five year guarantee period.
