HL 22 January 1998. R who were residential developers of detached houses of which they owned the copyright brought an action for infringement of copyright against B, who were also builders. R claimed for account of profits and additional damages under Copyright, Design and Patents Act 1988 s97.The Lord Ordinary allowed R`s claims but the Second Division of the Court of Session reversed the decision in relation to additonal damages. R appealed to the House of Lords. Appeal dismissed.
