LT 9 September 1997. N applied for the modification of a restrictive covenant t allow the erection of a dwelling house and garage on half an acre of the front garden of a cottage. Planning permission had been obtained. Restriction imposed in 1952 and provided that no building should be erected there without the written licence of the vendor who lived next door. The principal objectors were the owners of a house built in 1991 in the vendors garden. "Held" application dismissed.
