HL 26 February 1998. House holds that the right to a freehold under the Housing Act 1985 is not an equitable interest but a statutory interest giving rise to different rights in the tenant until the freehold has passed. Dance v Welwyn overruled. House also considered the powers of the County Court to order the adjournment of proceedings - Courts discretion - Housing Act 1985 Parts IV and V.
