"English Property Corporation plc v Kingston upon Thames RLBC" CA 5 March 1998. K acquired a strip of land by compulsory purchase order, for highway purposes. In assessing the compensation payable, the LT found that K had given notice to a new development (built by E) that the land was being acquired and they have kept the area clear. However, part of the buildings hung over the land. Compensation was set at £171,400. Both parties were unsatisfied and appealed. Appeal by K allowed and the figure of £85,700 substituted.
