Landlord objected and entered into agreement with a developer subject to developer obtaining planning permission. Consent refused on grounds of loss of recreational facility. Landlord decided to demolish tennis club and turn site into `brownfield` site. Judge decided in favour of landlord. Tenants appealed. Appeal allowed.
