ChD 8 December 1997. S occupied public house, on an agreement for a lease. Subject to terms of the lease, S had to purchase first defendant`s specialised beers. S incurred arrears of licence fees and ceased purchase of beers under the tie clause. S issued proceedings under the Treaty of Rome article 85(1), claiming damages, due to tie clause. First defendant issued notice to quit on S, claiming possession and arrear of licence fees. S sought relief from forfeiture. Held, Judgment given to first defendant. Agreed that S should have relief from forfeiture upon certain terms.
