"Wilkes v Coal Authority" CA 23 April 1998. Working of coal near claimant`s land. Subsidence occuring on land so claimant made claim under Coal-Mining (Subsidence) Act 1957 s1(2) for remedial works to be undertaken by Coal Authority. Whether subsidence caused by working of coal and whether subsidence affected fitness of land for intended purposes. Lands Tribunal allowing claim. Coal Authority appealed. Appeal dismissed.
