CA 11 December 1997. G owned the freehold of property in which it let part to another company (E) in the same group. E later assigned the lease to B. G then served a notice terminating the tenancy, stating that it would not oppose the grant of a new one. B`s subsequent appplication was answered with a request for interim rent. G then sold the freehold. B withdrew their application. B`s appeal that G could not pursue its claim for interim rent as Part II of the Landlord and Tenant Act 1954 did not apply to a tenancy by estoppel, was dismissed.
