CA 17 December 1997. L owned the lease on a block of maisonettes, for which it had arranged suitable insurance cover. When subsidence occurred to the block, L sought indemnities from the lessees to carry out remedial work, as the insurers had financial difficulties. All paid except A, who carried out work to his own maisonette himself. A`s claim for expenditure incurred and loss of prospective rental income was dismissed.
