CA 6 October 1997. D was granted options to purchase half-shares in two pieces of freehold by the defendants (J). The options were exercisable upon the grant of planning permission for industrial units, and would be null and void if not exercised within six years of such permission being granted. Planning permission was granted on 19 December 1994, and options sent by D on 17 February 1995 (received 20 February 1995). Appeal against earlier decision that time was of the essence of the options agreement dismissed.
