CA 31 July 1997. S served T with a repair notice requiring them to repair various premises to make them fit for human habitation. T carried out repairs and applied to S for improvement grants. Whilst these were initially approved, S refused to pay as the repair works were not up to the required standard. T brought proceedings for payment under private law. The district judge threw out this claim as the decision could only be heard through judicial review. "Held" Claim can be brought through private law.
