Burr and another v Eyre and others - 1998 - Estates Gazette [1998] 20 EG 132-136(5), (16/05/98) .

Central London CC 5 December 1997. The plaintiffs held a long lease of a house and premises. B additionally held a lease of a contiguous area of garden let on a series of short leases to the various tenants of the house since 1945. The tenants gave notice to acquire the freehold, describing "all the property comprised in the lease...". They later made application to amend their original notice as to include the garden, as this had been misdescribed in their first notice. The defendant landlords contended that the tenants were not entitled to acquire the garden. "Held" application to amend the notice dismissed.
