"Russell v Conetry and Solihull Waste Disposal CO Ltd", CA, 22 May 1998, held that where a ratepayer owned a site on which he burnt waste to produce electricity and also ran a schem to sell this product from the same site, the site was not a schem under the meaning of the Electricity Generating (rateable Values) order 1989 (SI 1989:2474) and was therefore to be rated as an ordinary hereditament.
