QBD 28 June 1994. Planning permission was refused for an out-of-town superstore as the emerging local plan had identified an application for a suitable site with proximity to the city centre. PPG6 (1988 version) advised applicants should be considered on their own merits without regard to the commercial effects on any other retailers unless the vitality and viability of a city centre would be affected. Applicants contended that the Inspector had misunderstood PPG6. Held that PPG6 provided the background to structure plan policy and where there was need on a more appropriate site, that would be justification for refusing planning permission for an out of town site.
