"West Kent Housing Association Ltd v Davies and another", CA 24 June 1998. D were tenants of the landlord housing association (W). Tenancy was assured weekly tenancy under Housing Act 1988 Part I. W sought an order for possession on grounds of breach of covenants. W claimed D had used the premises for commercial use by repairing vehicles and had also caused nuisance to a neighbour by racially abusing them. Judge declined to make a posssession order. W appealed, appeal allowed.
