CA 2 April 1998. G was appointed an almsperson and occupied a flat in an almshouse, enjoying exclusive occupation and paying a weekly sum towards the cost of maintenance and for essential services. The trustees terminated G`s appointment and gave her notice to vacate the flat. G claimed she was an assured tenant. The judge held on a preliminary issue that G was not an assured tenant. An appeal by G was dismissed on the basis that the relationship was one of trustee and beneficiary and, the almsperson`s right to exclusive occupation was referable to a legal relationship other than a tenancy.
