Inner House (Extra Division) 4 February 1998. The company obtained planning permission for the development of a church, which was a listed building. Various structures were erected within the curtilage of the church. The planning authority served enforcement notices requiring that the partially completed structure, which was of substantial size and had a marked visual impact be dismantled and removed from the site. The appellant`s appeal against the enforcement notice was dismissed by the reporter of the SoS. The appellant appealed specifying six grounds, including the contention that the reporter wrongly determined that a free-standing structure is subject to listed building control. The court refused all grounds of appeal.
